McBrearty Snr., awarded €2.5m 26.10.07

Frank McBrearty Senior was yesterday awarded nearly €2.5m by the High Court for damage suffered to his business due to Garda harassment following Ritchie Barron's death.
His company had initially submitted a claim for €7.2m, however, this was reduced to €6m in the course of the case heard in Castlebar, Co Mayo.
It included compensation for loss of profits for ten years, loss of business opportunities and loss of capital value.
But Mr Justice Paul Gilligan made an award for loss of profits for eight years and set the figure at €1.5m. Mr. McBrearty had claimed €3.2m in loss of profits. The State admitted liability in the case and the High Court sat to assess the amount to be awarded.
The judge said he accepted the McBreartys' evidence that they planned to build a restaurant and rooms onto their business and he awarded them €550,000 for loss of opportunities.
His High Court action for a personal claim for unlawful arrest, malicious prosecution, unlawful detention and defamation is due to begin in the High court in Castlebar next Tuesday.
